An invention, be it a product or process, can be considered for a patent if it is:
1) New or novel;
2) Involves an inventive step;
3) Capable of industrial exploitation;
4) Must not be excluded matter.
Things such as discoveries, mathematical methods, methods of medical treatments are some of the things that cannot be patented under the Patent Act.
In Singapore, patents have to be registered at the Intellectual Property of Singapore (IPOS). In order to have a patent granted, we can assist you in filing for a patent application in Singapore.
There are a few ways to file for patent in Singapore. It may begin with a provisional application which provides the specification of your invention without any claims. You may choose to do this before filing a complete application or start the process directly with the complete application.
Once it is granted, its term of a patent is 20 years from the date of filing, subject to the payment of annual renewal fees.
A patent can be used to prevent others from exploiting your invention without your consent. You can also license it to third parties for commercial returns or sell the patented invention.
A PCT is Patent Co-operation Treaty (PCT) which is an international treaty to facilitate the filing of patent applications in different countries concurrently. As patent protection is location based, if you want your invention to be protected overseas, separate applications will have to be made in each of the country where the patent protection is desired and one of the methods that can be used is through the PCT.
