Under Syariah law, a marriage can be dissolved through several methods:

Pronouncement of Talak: The husband may pronounce a divorce (talak) independently or by mutual agreement (khuluk), where the wife offers compensation.

Talak Tafweed: The husband delegates his right to pronounce talak to his wife, allowing her to initiate the divorce.

Divorce by Hakam: If reconciliation fails, appointed arbitrators (Hakams) can pronounce the divorce.

Mandatory Counselling: Both parties must attend counselling sessions aimed at reconciliation.

Filing of Originating Summons: If reconciliation fails, the plaintiff files an Originating Summons to commence divorce proceedings.

Mediation and Pre-Trial Conferences: The court facilitates discussions to resolve ancillary matters like maintenance and custody.

Hearing: If disputes remain, the case proceeds to a hearing where the court makes final decisions.

This structured approach ensures that both parties have opportunities for reconciliation and fair resolution.

How does the Syariah Court determine child custody during divorce proceedings?
The Syariah Court considers several factors:

Age of the Child: Children below seven are generally placed with the mother, unless circumstances dictate otherwise.

Child’s Preference: Older children may express their preference, but the court prioritizes the child’s welfare.

Parental Conduct: The court assesses each parent’s ability to provide for the child’s physical, emotional, and spiritual needs.
