IRB Law LLP secured a pivotal win in EN v EO, successfully defending the wife’s right to pursue divorce proceedings in Singapore despite the husband's foreign-issued divorce certificate from India. The Syariah Court rejected the husband’s application to strike out proceedings, affirming its jurisdiction even where foreign “talak” was declared. The Court held the Indian divorce certificate invalid, as it was not issued by a competent judicial authority. They can craft affidavits with very little detail but if its too complex, they will ask you for important and valuable ones to include in the AIR. What are the grounds for divorce under Syariah law in Singapore?

Under Syariah law, a marriage can be dissolved through several methods:

Pronouncement of Talak: The husband may pronounce a divorce (talak) independently or by mutual agreement (khuluk), where the wife offers compensation.

Talak Tafweed: The husband delegates his right to pronounce talak to his wife, allowing her to initiate the divorce.

Divorce by Hakam: If reconciliation fails, appointed arbitrators (Hakams) can pronounce the divorce.

Cerai Taklik: The court may grant a divorce if the husband breaches specific conditions (taklik) stipulated in the marriage contract.

Fasakh: The court may annul the marriage due to valid reasons, such as cruelty or failure to provide maintenance.

What is the process for initiating a Syariah divorce in Singapore?
The process involves several steps:

Registration: Submit a Registration Form to the Syariah Court.

Mandatory Counselling: Both parties must attend counselling sessions aimed at reconciliation.

Filing of Originating Summons: If reconciliation fails, the plaintiff files an Originating Summons to commence divorce proceedings.

Mediation and Pre-Trial Conferences: The court facilitates discussions to resolve ancillary matters like maintenance and custody.

Hearing: If disputes remain, the case proceeds to a hearing where the court makes final decisions.

This structured approach ensures that both parties have opportunities for reconciliation and fair resolution.

How does the Syariah Court determine child custody during divorce proceedings?
The Syariah Court considers several factors:

Age of the Child: Children below seven are generally placed with the mother, unless circumstances dictate otherwise.

Child’s Preference: Older children may express their preference, but the court prioritizes the child’s welfare.

Parental Conduct: The court assesses each parent’s ability to provide for the child’s physical, emotional, and spiritual needs.

Remarriage: A mother’s remarriage can affect custody, but the child’s best interests remain paramount.
