Wasiat
Apabila merancang harta pusaka mereka, orang Islam di Singapura tertakluk kepada undang-undang Syariah.
Keistimewaan di bawah undang-undang Syariah biasanya dikenali sebagai wasiat. Sama Seperti wasiat dalam undang undang sivil, wasiat dalam Islam juga menetapkan bagaimana harta si mati harus/akan diedarkan.
Terdapat beberapa perkara yang perlu diperhatikan apabila menulis wasiat dalam undang-undang Syariah.
Anda mestilah berusia sekurang-kurangnya 21 tahun dan mempunyai kemampuan mental yang sempurna.
Penandatanganan wasiat mesti disaksikan oleh sekurang-kurangnya dua orang lain.
Orang lelaki Islam yang akan mewarisi harta dalam wasiat tersebut tidak boleh dijadikan saksi.
Terdapat lebih banyak batasan untuk wasiat seorang Islam, berbanding dengan wasiat dalam undang-undang sivil. Contohnya, harta yang dimasukkan ke dalam wasiat tidak boleh melebihi satu pertiga daripada harta keseluruhan si mati.
Di samping itu, pewaris harta yang akan mewarisi harta si mati dalam undang-undang faraid tidak boleh mewarisi harta dalam wasiat si mati yang sama.. Contoh pewaris faraid adalah ibu bapa, pasangan, anak, cucu, dan adik beradik.
Kami juga menyarakan, selain menyediakan wasiat, anda juga membuat sebuah dokumen yang dipanggil, Lasting Power of Attorney (LPA) juga. LPA membolehkan anda melantik seseorang yang anda percayai untuk membuat keputusan untuk anda sekiranya anda tidak dapat membuat keputusan untuk diri anda sendiri disebabkan “kerosakan, atau gangguan dalam fungsi, minda atau otak.”
Hibbah
Hibbah merupakan “hadiah” di bawah undang-undang Syariah. Ini adalah salah satu alat yang digunakan dalam perancangan harta oleh peguam Syariah.
Lebih banyak isu boleh tertimbul jika seorang Islam itu telah membuat persediaan dalam undang-undang sivil, seperti meninggalkan wasiat yang tidak dibawah pertadbiran Islam, atau di mana orang Islam adalah seorang yang muallaf, iaitu beliau bukan seorang Islam ketika dilahirkan.
