Probate & Letters of Administration
Probate and Letters of Administration is a legal process of appointing the executor and administrator for the Deceased’s estate. An appointed executor named in the Deceased’s will can apply for Grant of Probate whereas the beneficiary of the estate can apply for Grant of Letters of Administration.
A Will is made to provide for the administration and distribution of a person’s assets upon his or her demise. Under the Wills Act, a Will to be valid must be in writing, signed by the Testator and signed by at least two witnesses.
A Lasting Power of Attorney (“LPA”) is a legal document appointing a Donee to make decisions on behalf of a person should a person lose mental capacity in the future and be unable to make decisions for himself.
Deputyship is a legal process whereby a Court appoints a Deputy to manage personal welfare or the property and affairs of another person who lose mental capacity to manage for himself.
