There is a large list of crimes that lead to arrest: assault, drug offences, homicide, rape, serious traffic offences, etc. According to Singapore’s Penal Code, someone who is cited for any of these offences can face significant jail time, fines, and/or other penalties. Yes, a police officer may conduct an unwarranted arrest if someone is reasonably suspected of doing something unlawful. Such arrests must be made on the premises of credible information and on indisputable facts. A person can be arrested without a warrant for a non-arrestable offence if he or she refuses to give a police officer his or her name and address when questioned. The good news is that someone who has been arrested without warrant can only be held in custody for a period of not more than 48 hours.

This means the police officer has gotten an order from the Courts to bring a person in. Typically, the police will conduct investigations on cases that involve the crime, and if the police officer thinks that the wrongdoer needs to be arrested, he or she will go to the Courts to get an arrest warrant. The arrested person must face the Courts, and depending on the offence, he or she may be offered bail.

After a person is arrested, he or she will be processed at a police station where he or she will be given the option of bail. Soon after, the person will be called to a Criminal Mentions Court. In Court, the person will do one of three things:

1. Plead guilty,

2. Seek a lawyer to examine options and represent him or her, or

3. Plead not guilty. After the person is charged at trial, the sentence will be served and the case ends.

  • –  According to Section 23 of the Criminal Procedure Code, the arrested person has the right to remain silent after the notice is read out to him. However, the police may infer guilt from his silence.


  • –  According to Article 9 of the Constitution, every detained person has the right to call a lawyer while under police custody at a reasonable time.


  • – The detainee can also contact family members, but the police may reject the request if talking to family members can potentially interfere with investigations.

The Court, any police officer who ranks higher than a sergeant and certain other law enforcement officers have the right to grant bail. The bail is offered after the person’s arrest and before he or she is charged in Court. Please see our page on bail in Singapore for more information.
